Planning appeals

Planning applications are usually granted permission or refused permission. A planning officer would usually justify his/her decision by producing an officer’s report outlining the reasons the decision was made including any relevant conditions attached to the decision. There are times that the council do not make the right decision and this is where we can help. We can review the application and reasons for refusal and advise our client if there is a fairly good chance of successfully challenging the refusal by appealing.

Our chartered Town Planners will research the refused application, assess whether there are strong grounds for appealing and if so, we will prepare the appeal statement arguing why the refusal should be overturned and planning permission should be granted.

We will look at precedent, all relevant planning policies and guidance, case law and other material considerations to support the appeal.

Once the appeal statement is ready we will submit this to the Planning Inspectorate. The Planning Inspectorate (PINS) is a government body independent of the council.

Appeals for Home Owners

If you’re a home owner you’re entitled to an appeal if you’ve been refused. You have 12 weeks from the time you receive your refusal. This gives you enough time to gather evidence and any further additional information to present to the planning inspectorate.
